1. Scope of Services
Forma Haus provides interior design consultancy and project coordination services in Malaysia, including Design Consultation & Mood Mapping, Full Design Development, and Implementation Support. The specific deliverables, timeline, and fee for each engagement are set out in a written proposal or service agreement provided prior to commencement.
Services are tailored to each client's requirements. Any scope adjustments must be agreed in writing before additional work begins. Forma Haus does not offer construction contracting; our Implementation Support service involves coordination and quality oversight, not direct construction management.
2. Quotes & Proposals
All quotes and proposals are prepared based on the information provided at the time of enquiry. Prices are quoted in Malaysian Ringgit (MYR) and are subject to change if the scope changes materially after a proposal is issued.
Proposals are valid for 30 days from the date of issue. Accepting a proposal in writing (by email or signed agreement) constitutes a binding commitment to proceed under the stated terms.
3. Payment Terms
Payment schedules are outlined in the service agreement. As a general guide:
- Design Consultation & Mood Mapping: Full payment is due prior to the session.
- Full Design Development: A 50% deposit is required to commence; the remaining 50% is due upon delivery of the finalized design package.
- Implementation Support: Phased invoicing aligned with project milestones, as agreed in the service agreement.
All payments are accepted via bank transfer to Forma Haus's registered account. Payment receipts will be issued for each transaction.
Late payments may result in a pause to project work. We will communicate directly before taking any such step, as we prefer to resolve matters through open discussion.
4. Revisions & Changes
The Full Design Development service includes two rounds of feedback and revisions. Additional revision rounds requested beyond this allowance may attract supplementary fees, which will be quoted before work proceeds.
Significant changes to the original brief — including changes to the property, intended use, or budget — may require a revised proposal. We will always discuss options with you transparently before adjusting any terms.
5. Timelines & Delays
Estimated timelines are provided in good faith and are based on typical project conditions. Delays may occur due to client feedback cycles, third-party supplier lead times, site conditions, or circumstances outside our reasonable control.
We commit to communicating proactively about any factors that may affect the schedule. Where a delay is attributable to Forma Haus, we will work to resolve it without additional cost to the client.
6. Intellectual Property
All design concepts, mood boards, layouts, drawings, and documents produced by Forma Haus remain the intellectual property of Forma Haus until full payment has been received.
Upon receipt of final payment, clients are granted a non-transferable licence to use the design materials for the specific project they were created for. Forma Haus retains the right to feature completed project images in our portfolio, website, and marketing materials, unless the client requests otherwise in writing.
Clients may not reproduce, distribute, or sell Forma Haus design materials to third parties without prior written consent.
7. Confidentiality
Forma Haus respects the privacy of every client and treats all project information — including home layouts, budgets, personal preferences, and correspondence — as confidential.
We will not share client-specific information with any third party unless required to deliver the agreed services (e.g., disclosing contact details to a supplier with the client's knowledge) or as required by law.
8. Limitation of Liability
Forma Haus provides design consultancy services and is not responsible for construction defects, contractor errors, or product failures once materials have been installed by third-party contractors.
Our Implementation Support service involves coordination and oversight, not direct construction responsibility. Clients are encouraged to retain their own contracts with construction and supply vendors.
To the extent permitted by Malaysian law, Forma Haus's total liability in connection with any engagement shall not exceed the total fees paid for that engagement.
9. Termination
Either party may terminate a service agreement by providing 14 days' written notice. In the event of client-initiated termination:
- Fees for work completed to the termination date are payable.
- Deposits are non-refundable where work has already commenced.
- All design materials created up to the point of termination will be delivered upon clearance of any outstanding balance.
We prefer to address concerns through open conversation before termination becomes necessary. Please reach out to us if you have any reservations at any stage of the project.
10. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through direct, good-faith discussion. If the matter cannot be resolved informally within 30 days, either party may refer the dispute to mediation through the Malaysian Mediation Centre prior to pursuing legal proceedings.
Nothing in this clause prevents either party from seeking urgent injunctive or interim relief from a court of competent jurisdiction.
11. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Malaysia.
